Subject: Soil testing - fraud?

We live in the Denver area and bought a lot from some people, to build on, 
and at the closing they joked about "better us than them" building on it.

Then we found out that the soil was really expansive and needed caisons for 
us to build there. 

We now suspect disclosure fraud. People are required to tell you, in 
Colorado, if they know something is wrong with property they are selling you.

Is there any way to find out if these people knew in advance and sold us the 
lot without telling us? If they had a soil test done anywhere?
