I contacted the builder and he sent both the HVAC and Electrician :

Electrician - The Air conditioner is drawing too much power.  It's
probably a bad compressor.

HVAC - The compressor is fine, it's just a large draw and normal.  He
attached a hard start kit.

Still getting flickering.
